Terms of service and online sale

This document sets out the terms for using the Baltic Experience site and for buying from us online. We have written it in plain language, but it is binding on both sides. If anything is unclear, write to us before you buy.

1General provisions

1.1

These terms set out the rules for using the Baltic Experience website and the rules for sales made through it.

1.2

The service provider and seller is NEOGRAFIKO spółka z ograniczoną odpowiedzialnością (NEOGRAFIKO sp. z o.o.), with its registered office in Starogard Gdański, address: Osiedle 60-lecia Odzyskania Niepodległości Polski 14/4, 83-200 Starogard Gdański, Polska.

1.3

The company is entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000920900. Registry court: Sąd Rejonowy Gdańsk-Północ w Gdańsku, VII Wydział Gospodarczy Krajowego Rejestru Sądowego. Tax ID (NIP): 5922285976, statistical number (REGON): 389905136, share capital: 5 000,00 zł.

Baltic Experience is the trading name under which NEOGRAFIKO sp. z o.o. organises catamaran cruises on the Gulf of Gdańsk, on-water events and sailing trips.

1.6

These terms cover:

  • free electronic services provided through the site (browsing content, enquiry and cooperation forms, the booking configurator, the cart),
  • online sale of participation in the Baltic Experience Croatia 2026 trip,
  • payment, cancellation, complaint and withdrawal rules,
  • booking rules for Tricity cruises, which we handle by enquiry rather than through the shop.
1.7

These terms are available on the site free of charge, in a form that can be viewed, downloaded, saved and reproduced on your own device.

1.8

Using the site means accepting these terms. Placing an order requires explicit confirmation of acceptance in the form.

2Definitions

2.1

The terms used in this document mean:

  • Site: the Baltic Experience website and all its subpages.
  • Service provider, Seller: NEOGRAFIKO spółka z ograniczoną odpowiedzialnością.
  • Customer: a natural person, legal person or organisational unit who uses the site or places an order.
  • Consumer: a natural person carrying out a legal act not directly related to their business or professional activity.
  • Trader with consumer rights: a natural person entering into a contract connected with their business activity where the content of the contract shows it is not of a professional nature for them. They are entitled to some consumer rights under the Consumer Rights Act (ustawa o prawach konsumenta).
  • Electronic service: a service performed by the Service Provider by electronic means, meaning the forms, the enquiry configurator, the cart and the order form.
  • Order: a Customer's declaration of intent to enter into a sales contract for a Product, submitted through the order form on the site.
  • Product: participation in the Baltic Experience Croatia 2026 trip in the chosen standard, sold as a cabin for 2 people or as a berth in a shared cabin.
  • Tricity cruise: a catamaran cruise on the Gulf of Gdańsk and Tricity waters (Morning Escape, Sunset Cruise, Golden Hour Club, Private Charter, events), booked by enquiry.
  • Terms of participation: the "Croatia 2026 Terms of Participation" document available on the site, which forms an integral part of the contract for the Product.
  • Contract: a Product sales contract or a contract for the provision of an electronic service, entered into between the Customer and the Seller.

3Services provided by electronic means

3.1

The Service Provider offers the following services on the site free of charge: browsing content, the cruise enquiry form with the configurator, the contact form, the cooperation form with attachments, the cart and the order form.

3.2

These services are free of charge. We do not charge for using the site.

3.3

The contract for using the content-browsing part of the site is entered into for an indefinite period and ends when you leave the site. The contract for the form, configurator or cart is entered into for a fixed period and ends when the form is sent or when you stop using that feature.

3.4

To use the site you need:

  • a device with internet access,
  • an up-to-date web browser supporting JavaScript and cookies,
  • an active email address,
  • for online payment: access to online banking, the BLIK app, or a payment card.
3.5

The Customer must not submit unlawful content, including third-party personal data supplied without a legal basis, and must not use the site in a way that disrupts its operation or places an unreasonable load on its infrastructure.

3.6

Complaints about electronic services (form errors, broken features, problems accessing the site) should be sent to [email protected]. Please describe the fault and when it occurred. We reply within 14 days.

3.7

The Service Provider may suspend access to the site for technical work. We announce planned outages if they are expected to last longer than a few hours.

4Booking Tricity cruises and events

4.1

Tricity cruises and on-water events (Morning Escape, Sunset Cruise, Golden Hour Club, Private Charter, birthdays, hen and stag parties, engagements, corporate outings and team events) are booked by enquiry sent through the site, by phone, or by email.

4.2

Sending an enquiry does not create a contract and does not hold the date.

4.3

On receiving an enquiry, we contact the Customer by email or phone and confirm the date's availability, the price, the duration, the meeting point and the remaining terms. The contract only comes into effect once both parties confirm these details.

4.4

Prices shown on the site for Tricity cruises are indicative and depend on the date, the number of guests and any extras ordered. The price stated in the booking confirmation is binding.

4.5

If the booking terms call for a deposit, we state its amount, due date and payment method in the confirmation, along with the rules for refunding the deposit on cancellation.

4.6

The rules set out in the "Weather and safety" section apply to Tricity cruises.

5Online sale: order and contract formation

5.1

The subject of the online sale is the Product, meaning participation in the Baltic Experience Croatia 2026 trip taking place 26.09-03.10.2026.

5.2

For each Product we state the standard, description, photos, boat specification and price. Prices are gross prices in Polish złoty and include applicable taxes.

5.3

An order is placed in the following steps: choosing the standard and option (cabin or berth in a shared cabin), adding it to the cart, filling in the order form (first and last name, email, phone, optional invoice details), accepting these terms and the terms of participation, proceeding to payment.

5.4

Placing an order requires accepting these terms and the Croatia 2026 terms of participation. We store the version of both documents accepted at the time of order together with the order.

5.5

After placing an order, the Customer receives an order number in the format BE-2026-NNNNNN and is redirected to payment. Until the payment is recorded, the order has pending status.

5.6

The sales contract is formed once the Seller confirms acceptance of the order. We send confirmation by email once the full payment has been recorded.

5.7

The Seller may refuse to accept an order if the chosen berth is no longer available or if the order details are incomplete or false. In that case we refund the full amount paid within 14 days.

5.8

We issue an invoice on the Customer's request. The Customer provides invoice details in the order form. We send the invoice electronically to the email address given with the order; by placing the order, the Customer consents to this.

5.9

The Product price does not include costs that the terms of participation list as additional, including travel to and from Croatia, fuel, marina and port fees, meals and insurance.

5.10

Only an adult may place an order.

6Payments

6.1

Payment for the Product is made in advance, in full, when the order is placed.

6.2

Online payments are handled by Paynow. The operator is mElements S.A., with its registered office in Warsaw at ul. Prosta 18. Payments are settled under the operator's own terms, available on the Paynow site.

6.3

Available payment methods:

  • BLIK,
  • fast online transfers (pay-by-link),
  • Visa and Mastercard payment cards,
  • Apple Pay,
  • Google Pay.
6.4

Settlement currency is the Polish złoty. The Seller does not charge any extra fee for choosing any of the payment methods.

6.5

The Customer has 45 minutes from placing the order to complete payment. After that the order expires and the reserved berth returns to the available pool. An expired order creates no obligations on either side. The berth can be purchased again if still available.

6.6

The payment date is the day on which the Seller receives confirmation from the payment operator that the payment has been recorded.

6.7

We do not collect or store payment card details or online banking login details. The Customer provides these directly to the payment operator.

7Order fulfilment

7.1

The Product is a service. The sale does not involve delivery of goods, so we do not charge shipping costs and do not send parcels.

7.2

Promptly after the payment is recorded, and no later than within 24 hours, we send an order confirmation to the given email address: order number, list of items, amount paid, and the terms and terms of participation in the version accepted at purchase.

7.3

The service is delivered 26.09-03.10.2026 in Croatia, on the route and under the rules set out in the Croatia 2026 terms of participation.

7.4

We share organisational information before departure by email and in a closed group for participants: boat pick-up times and location, boat and cabin assignment, packing list, coordinator contact, and programme details.

7.5

The Customer is responsible for the accuracy of the email address and phone number given. If confirmation has not arrived within 24 hours of payment, please contact us at [email protected].

8Withdrawal from the contract

8.1

As a rule, a consumer and a trader with consumer rights may withdraw from a distance contract within 14 days, without giving a reason. The law does, however, provide for exceptions.

8.2

For the Croatia 2026 Product, the right of withdrawal does not apply. Under art. 38 ust. 1 pkt 12 of the Act of 30 May 2014 on Consumer Rights (ustawa o prawach konsumenta; the provision excluding the withdrawal right for services with a fixed delivery date), the right of withdrawal is excluded for contracts for accommodation other than for residential purposes, carriage of goods, car rental, catering, and services related to leisure, entertainment, sporting or cultural events, where the contract specifies a day or period for the service.

8.3

The Croatia 2026 trip has a fixed date and includes accommodation on the boat, transport, and leisure-related services, so this exclusion applies to it. By placing an order and accepting these terms, the Customer acknowledges that, once the contract is formed, they will not be able to withdraw from it under the 14-day right.

8.4

This does not remove the Customer's ability to cancel their participation. The rules for cancellation, transferring participation to another person, and refunds are set out in the "Cancellation, transfer of participation and refunds" section.

8.5

For the free electronic services provided on the site, a consumer may withdraw from the contract within 14 days without giving a reason, by sending a statement to [email protected]. These services are free, so withdrawal involves no settlement of any kind.

9Cancellation, transfer of participation and refunds

9.1

The rules in this section apply to the Croatia 2026 Product. Cancellation terms for Tricity cruises are set out in the booking confirmation.

9.2

Cancellation requires a statement sent by email to [email protected]. The date the message reaches the Seller is what counts.

9.3

For a cancellation submitted 60 days before the trip start date or earlier, we refund 70% of the price paid for the Product.

9.4

For a cancellation submitted between 59 and 31 days before the trip start date, we refund 50% of the price.

9.5

For a cancellation submitted 30 days before the trip start date or later, no refund is due. By this stage the charter, marina and programme costs have already been incurred.

9.6

Thresholds are counted in calendar days up to the trip start date, i.e. up to 26.09.2026.

9.7

Up to 7 days before the trip start date, the Customer may transfer their participation to another person who meets the terms of participation, free of charge. It is enough to send that person's details by email and receive confirmation from the Seller. Any financial settlement between the Customer and the person named takes place outside the site.

9.8

If the organiser cancels the trip, the Customer receives a full refund of the amount paid within 14 days of the cancellation being announced.

9.9

We issue refunds using the same payment method used for the payment, unless the Customer expressly agrees to another method that involves no cost to them.

9.10

We pay the refund within 14 days of the day we confirmed acceptance of the cancellation.

10Weather and safety

10.1

We sail on open waters. Whether to go out to sea, the route and any stops are decided based on the safety of guests and crew. The final decision rests with the boat's skipper and the organiser.

10.2

For the Croatia 2026 trip, a change to the route, the order of ports, stopping points, departure times, or individual parts of the programme, arising from weather, sea conditions, decisions of the maritime authorities, or marina availability, does not constitute a defect in the service and does not entitle the Customer to a refund or a price reduction. In that case the organiser provides a programme of a similar character.

10.3

For Tricity cruises, if conditions do not allow going out to sea, we agree a new date together. If a new date cannot be agreed, we refund the amounts paid in full within 14 days.

10.4

We inform Customers of a cancelled or rescheduled Tricity cruise by phone or email as soon as possible.

10.5

The skipper may refuse to take on board a person whose condition endangers the safety of the cruise. In that case no refund is due.

11Complaints and dispute resolution

11.1

We accept complaints by email at [email protected] or in writing at Osiedle 60-lecia Odzyskania Niepodległości Polski 14/4, 83-200 Starogard Gdański.

11.2

A complaint should include:

  • the name and contact details of the person submitting it,
  • the order number, or the date and type of service,
  • a description of the issue and when it occurred,
  • the outcome the Customer expects.
11.3

We reply within 14 days of receiving the complaint, to the email or postal address it came from. If we do not reply to a consumer's complaint within that time, the complaint is treated as accepted.

11.4

The Seller is liable to the Customer for the conformity of the service with the contract under generally applicable law.

11.5

A consumer may use out-of-court methods of handling complaints and pursuing claims, in particular by:

  • seeking help from the municipal or district consumer ombudsman (rzecznik konsumentów),
  • applying to the relevant regional inspector of the Trade Inspection (Inspekcja Handlowa) to initiate mediation,
  • applying to have the case resolved by the permanent arbitration court operating at the relevant regional Trade Inspection office,
11.6

Using out-of-court dispute resolution is voluntary and requires the agreement of both parties.

11.7

Polish law governs contracts entered into under these terms. This choice of law does not deprive a consumer of the protection granted by mandatory provisions of the law of their habitual residence.

11.8

Disputes with a Customer who is neither a consumer nor a trader with consumer rights are resolved by the court with jurisdiction over the Seller's registered office.

12Personal data

12.1

The controller of Customers' personal data is NEOGRAFIKO spółka z ograniczoną odpowiedzialnością, Osiedle 60-lecia Odzyskania Niepodległości Polski 14/4, 83-200 Starogard Gdański.

12.2

The purposes and legal bases for processing, recipients of the data, retention periods, data subjects' rights, and the rules on cookies are described in the Privacy Policy available on the site.

12.3

Providing personal data is voluntary but necessary to handle an enquiry and to enter into and perform a contract.

12.4

The payment operator processes transaction-related data as a separate controller, under its own documentation.

13Final provisions

13.1

These terms, version 1.0, are in force from 1 September 2026.

13.2

The Seller may amend these terms for good cause: changes in the law, changes to how services are provided, changes to the scope of the offer, or to the available payment methods. Changes are published on the site at least 14 days in advance.

13.3

Orders placed before a change takes effect are governed by the version of these terms accepted at the time of the order. We keep that version together with the order.

13.4

Matters not covered by these terms are governed by Polish law, in particular the Civil Code (Kodeks cywilny), the Consumer Rights Act (ustawa o prawach konsumenta), and the Act on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną).

13.5

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in force.
